The intersection between the E-2 Visa and investing in real estate is the topic of our recent video podcast organized by Joorney.

During the conversation, Real Estate and E-2 Visa: Your Complete Guide, hosted by Joorney Brand Ambassador Marcos Bravo, includes expert insights from special guest and immigration professional Isaul Verdin. Together, they look at the E-2 Visa from different angles, discuss its connection to the real estate industry, and much more.

The American E-2 Visa category provides a legal path to living and working in the U.S. based on an investment made by the visa holder. That alone is enough to put the E-2 on the radar of investors around the world interested in identifying a possible avenue for new projects.

In recent years, however, the scope of “investment” has expanded to include those active in the American real estate market, and an increasing number of foreign investors are successfully leveraging the E-2 to create new opportunities.

This development is easier to understand when you consider some of the reasons why real estate is the ideal investment under the terms of the E-2 program:

  • No Fixed Minimum Investment: Unlike other visas, such as the EB-5, which require a minimum investment of $800,000 to $1,050,000, the E-2 visa does not have a fixed investment threshold. Instead, the investment must be “substantial” relative to the type of business. This flexibility allows real estate investors to tailor their investments to the size and scope of their business.
  • Business Control: The E-2 visa allows investors to maintain control over their investments, requiring them to own at least 50% of the business and to be actively involved in its management. This appeals to real estate investors who wish to directly manage their properties, developments, or real estate-related businesses.
  • Indefinite Renewability: The E-2 visa can be renewed indefinitely if the business remains viable and meets visa requirements. This allows real estate investors to build long-term business strategies without the pressure of a limited visa duration.
  • Temporary Stay with Potential for Long-Term Residency: While the E-2 visa is technically a non-immigrant visa, it provides the opportunity to live in the U.S. for an extended period, with the option to renew as long as the business remains active.
  • Family Inclusion: The E-2 visa allows investors to bring their spouse and children under 21 to the U.S. The spouse can apply for work authorization, and children can attend U.S. schools without the need for a separate visa.
  • Broad Range of Eligible Investments: The E-2 visa supports a wide range of real estate activities, from property development and management to real estate consulting and brokerage. This versatility allows investors to engage in different facets of the real estate market.
  • U.S. Market Access: The E-2 visa provides foreign investors with direct access to the lucrative U.S. real estate market, which is one of the largest and most dynamic in the world.
  • Availability for Treaty Countries: For nationals of countries with an E-2 treaty, the visa provides a straightforward pathway to live and invest in the U.S. without the complexities of other visa categories.

Put all of these together and the result is a very attractive investment opportunity for those wishing to live and work in the United States.
